Our clients mined coal. They were told to go home and that they might be recalled, but not when. They heard nothing, and we filed the WARN action because they’d been effectively terminated. The company staged a “recall” but would not hire anyone who didn’t show up on the particular morning. Despite motions to dismiss the miners’ case, we settled it for those ultimately who got no WARN notice or further pay.
