Our clients brought to market the first luxury, hybrid electric-combustion engine car, the Fisker Karma, designed by Henrik Fisker. Despite the efforts of the team devoted to its success, it fell victim to a series of unfortunate events, and ran out of funds. It terminated, without notice, 160 employees from its Anaheim, California headquarters and seven months later, filed for bankruptcy in Delaware. Due to its long pause before bankruptcy, the company refused to treat the WARN Act wages as priority claims under the Bankruptcy Code’s rules. At trial, Raisner Roupinian prevailed by winning a ruling that restored the priority treatment. The case is ongoing.
